The former Teso North Member of Parliament Arthur Papa Odera filed a petition at the Busia High Court on Friday challenging the election of Oku Kaunya as the area MP.
Odera who was defending the seat on Jubilee ticket named the Kaunya of ANC as first respondent and the Independent, Electoral and Boundary Commission as the second respondent.
Odera said he had filed a formidable petition with the aim of removing the incumbent through legal process.
In his petition Odera claims there was massive theft of votes with his agents not allowed to assist illiterate voters during the voting process, adding that this was made possible through bribing the presiding officers.
The former MP also alleged that the exercise was riddled with vote buying which was a breach of the electoral laws and the constitution.
The petition was the second to be filed in Busia County. The former Teso South MP Mary Emaase (Jubilee) was the first to file a petition over two weeks ago challenging the election of Geoffrey Omuse of ODM as the area MP.
In her petition Emaase claimed that there was fraudulent tabulations and tallying of figures particularly by the Returning Officer, adding that she won by more than 1000 votes but was not declared the winner.
